1. Introduction

At Ecomotion, we want you to be completely satisfied with your purchase. This Refund Policy outlines your rights to return products and receive refunds in accordance with European Union consumer protection laws, including the Austrian Consumer Protection Act (Konsumentenschutzgesetz – KSchG) and the Austrian Act on Distance and Off-Premises Contracts (Fernabsatz- und Ausweisgesetz – FAG), which implement the EU Consumer Rights Directive (2011/83/EU).

2. Your Right of Withdrawal (Cooling-Off Period)

2.1 14-Day Right of Withdrawal

As a consumer purchasing from within the European Union, you have the right to withdraw from your purchase within 14 days without giving any reason. This is in compliance with the EU Consumer Rights Directive (2011/83/EU).

The withdrawal period expires 14 calendar days from the day on which you, or a third party indicated by you (other than the carrier), acquires physical possession of the goods.

2.2 How to Exercise Your Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by a clear statement. You can do this by:

3. Effects of Withdrawal

3.1 Refund

If you withdraw from the contract, we will reimburse all payments received from you, including the costs of delivery (except for supplementary costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us).

We will make the reimbursement without undue delay and no later than:

  • 14 days after we receive the returned goods; or
  • 14 days after you provide evidence of having sent back the goods, whichever is earlier

3.2 Refund Method

We will use the same means of payment that you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.

3.3 Return of Goods

You must send back the goods to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal to us. The deadline is met if you send back the goods before the 14-day period has expired.

3.4 Return Costs

You will bear the direct cost of returning the goods. The estimated maximum cost depends on the size and weight of the goods and your location.

3.5 Condition of Returned Goods

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. Products should be returned in their original packaging when possible, and must not be used beyond what is necessary to assess the product.

4. Exceptions to the Right of Withdrawal

In accordance with EU law, the right of withdrawal does not apply to:

  • Sealed goods which are not suitable for return due to health protection or hygiene reasons, if they were unsealed after delivery
  • Goods that have been mixed inseparably with other items after delivery
  • Goods made to your specifications or clearly personalized
  • Goods which are liable to deteriorate or expire rapidly

For dietary supplements, if the product seal has been broken and the product has been consumed or tampered with beyond initial inspection, we reserve the right to deduct a proportional amount from the refund to account for the diminished value.

5. Defective or Damaged Products

5.1 Your Rights for Defective Products

If you receive a product that is defective, damaged, or not as described, you are entitled to a remedy under EU consumer law. Under Austrian law (ABGB), you have statutory warranty rights for 2 years from delivery.

5.2 Remedies Available

  • Repair or Replacement: We will first offer to repair or replace the defective product at no cost to you
  • Price Reduction: If repair or replacement is not possible or would cause significant inconvenience, you may request a price reduction
  • Full Refund: If the defect is substantial and cannot be remedied, you are entitled to a full refund

5.3 How to Report Defective Products

Please contact us as soon as possible after discovering any defect. Include your order number, photos of the defect, and a description of the issue.

6. Wrong or Incomplete Orders

If you receive the wrong product or your order is incomplete, please contact us within 7 days of delivery. We will arrange for the correct products to be sent to you and provide a prepaid return label for the incorrect items.

7. Refund Processing Time

Once we receive your returned items and verify their condition, we will process your refund. Please allow:

  • 1-3 business days for us to process the refund
  • 5-10 business days for the refund to appear in your account (depending on your payment provider)

8. Non-Refundable Items

The following are not eligible for refund:

  • Products returned after the 14-day withdrawal period (unless defective)
  • Products that have been unsealed and used beyond initial inspection (for hygiene reasons)
  • Gift cards or promotional vouchers

9. Order Cancellation

If you wish to cancel your order before it has been shipped, please contact us immediately. We will make every effort to cancel the order and issue a full refund. Once an order has been shipped, it cannot be cancelled, but you may exercise your right of withdrawal upon receipt.
